This is a translation. The French version prevails (« la version française fait foi »): Conditions générales de vente.
In force as of 13 October 2026.
1. The seller
The artworks shown on clemencedevienne.com are sold by:
- Clémence Devienne, sole trader (entrepreneure individuelle, EI), visual artist (artiste-auteure)
- 12 rue de Cambrai, 75019 Paris, France
- Phone: +33 7 61 64 60 90
- Email: clemencedevienne.art@gmail.com
- SIRET: 489 446 039 00013
In these terms, “we” means the seller and “you” means the buyer.
2. Scope
These general terms of sale apply to every order placed on the website by a consumer, that is, an individual buying for personal use.
By confirming your order, you declare that you have read and accepted these terms. The applicable version is the one online on the day of the order.
3. The artworks
The artworks are unique originals. Each artwork exists in a single copy and can only be sold once. A sold artwork is marked as such on the website.
Each product page states the essential characteristics of the artwork: title, technique, medium, dimensions and, where applicable, framing.
The photographs are as faithful as possible. However, the colours you see may vary depending on your screen settings. Such a difference is not a defect of the artwork.
4. Prices and VAT
Prices are shown in euros, all taxes included. Delivery costs are shown separately, before you confirm the order (section 7).
Sales of works of art are subject to VAT at the reduced rate of 5.5% (Article 278-0 bis of the French General Tax Code).
- Delivery in France and in the European Union: the displayed price includes French VAT at 5.5%. For other EU countries, French VAT applies as long as our distance sales within the EU remain below the threshold of €10,000 excluding VAT per year.
- Delivery outside the European Union: the sale is an export. It is invoiced without French VAT, that is, excluding tax. Customs duties, taxes and import fees of the destination country are payable by you.
The applicable price is the one displayed when you confirm the order.
5. Ordering
To order:
- add the artwork to your cart;
- enter your contact details and delivery address;
- choose the delivery method or collection from the studio;
- check the summary: artwork, price, delivery costs, total; you can then correct your order;
- accept these terms of sale;
- confirm the order with the button “Order with obligation to pay”, then pay.
The order is confirmed when payment is received. A summary email is then sent to you.
As each artwork is unique, if two people order it at almost the same time, only the first paid order is accepted. The other buyer is informed and refunded in full.
For any order of €120 or more, the contract is kept for 10 years. You can access it on simple request by email (Articles L213-1 and D213-2 of the French Consumer Code).
6. Payment
Payment is made online, through PayPal:
- by bank card;
- with a PayPal account;
- in 4 instalments, when PayPal offers this option and subject to acceptance by PayPal.
The website neither receives nor stores any bank card data: it is processed directly by PayPal.
7. Delivery
Areas and rates
Delivery costs apply per artwork. They include VAT.
| Type of artwork | France | Outside France |
|---|---|---|
| Canvas | €9.60 | €39 |
| Framed artwork | €17 | €79 |
| Silver gelatin photo paper | €4 | €35 |
- France: insured Colissimo shipping.
- Outside France: insured shipping by carrier.
- Collection from the studio in Paris: free, by appointment arranged by email.
Delivery time
Artworks are shipped within 5 working days after payment is confirmed. Transit time then depends on the carrier and the destination. In any event, the artwork is delivered without undue delay and no later than 30 days after the contract is concluded (Article L216-1 of the French Consumer Code). For a pick-up at the studio, the appointment is arranged by e-mail within the same 5 working days.
In case of delay, you may give us formal notice to deliver within a reasonable additional period. If the artwork is not delivered within that period, you may terminate the contract and be refunded (Articles L216-6 and L216-7 of the French Consumer Code).
Receipt
On receipt, check the condition of the parcel in the presence of the delivery person. If it is damaged, record precise reservations with the carrier and let us know by email, with photos, as soon as possible. Not recording reservations does not deprive you of your legal warranties.
8. Transfer of ownership and risk
Ownership of the artwork passes to you upon full payment of the price.
The risk of loss or damage passes to you when you, or a third party designated by you, take physical possession of the artwork (Article L216-2 of the French Consumer Code). If you hand the artwork to a carrier you have chosen yourself, the risk passes to you when it is handed over to that carrier (Article L216-3).
9. Right of withdrawal
This right is provided for by Articles L221-18 et seq. of the French Consumer Code.
Withdrawal period
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period will expire fourteen days after the day on which you, or a third party other than the carrier and designated by you, take physical possession of the goods.
How to withdraw
To exercise the right of withdrawal, you must inform us (Clémence Devienne, 12 rue de Cambrai, 75019 Paris, France; phone: +33 7 61 64 60 90; email: clemencedevienne.art@gmail.com) of your decision to withdraw from this contract by an unequivocal statement (for example, a letter sent by post or an email). You may use the model withdrawal form at the end of these terms, but it is not obligatory.
You can also exercise your right of withdrawal online at “Withdraw from the contract here” (link at the bottom of every page and in order e-mails). If you use this online function, we will send you, without delay, an acknowledgement of receipt of the withdrawal on a durable medium (for example, by email), including its content and the date and time of its submission.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal
If you withdraw from this contract, we will reimburse all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed of your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back the goods or hand them over to us, at 21 rue Mathis, 75019 Paris, France, without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired.
You will have to bear the direct cost of returning the goods.
You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
Advice: artworks are fragile and unique. Return them in their original packaging, with insured shipping.
10. Legal warranties
All artworks are covered by the legal guarantee of conformity (Articles L217-3 et seq. of the French Consumer Code) and the guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code).
To make a claim, write to clemencedevienne.art@gmail.com describing the defect, with photos. If the artwork has to be returned to us, we will tell you how; the return costs are then paid by us.
As an original artwork is unique, it cannot be replaced by an identical item.
The text below is required by Article D211-2 of the French Consumer Code and its annex. Only the French text is official; this is a translation for information.
|
The consumer has a period of two years from delivery of the goods to obtain the application of the legal guarantee of conformity if a lack of conformity appears. During this period, the consumer only has to establish the existence of the lack of conformity, not the date on which it appeared. Where the contract of sale provides for the continuous supply of digital content or a digital service for a period of more than two years, the legal guarantee applies to that digital content or digital service throughout the planned period of supply. During this period, the consumer only has to establish the existence of the lack of conformity affecting the digital content or digital service, not the date on which it appeared. The legal guarantee of conformity obliges the professional, where applicable, to provide all updates necessary to keep the goods in conformity. The legal guarantee of conformity entitles the consumer to have the goods repaired or replaced within thirty days of the request, free of charge and without major inconvenience. If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee. If the consumer asks for the goods to be repaired but the seller imposes a replacement, the legal guarantee of conformity is renewed for two years from the date of replacement of the goods. The consumer may obtain a reduction of the purchase price while keeping the goods, or end the contract and be refunded in full on returning the goods, if: 1° The professional refuses to repair or replace the goods; 2° The repair or replacement takes place after a period of thirty days; 3° The repair or replacement causes major inconvenience to the consumer, in particular where the consumer definitively bears the costs of taking back or removing the non-conforming goods, or bears the costs of installing the repaired or replacement goods; 4° The lack of conformity persists despite the seller’s unsuccessful attempt to bring the goods into conformity. The consumer is also entitled to a price reduction or to termination of the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination. The consumer is then not required to ask for repair or replacement first. The consumer is not entitled to terminate the sale if the lack of conformity is minor. Any period during which the goods are immobilised for repair or replacement suspends the remaining guarantee period until the restored goods are delivered. The rights mentioned above result from Articles L. 217-1 to L. 217-32 of the French Consumer Code. A seller who obstructs the application of the legal guarantee of conformity in bad faith is liable to a civil fine of up to €300,000, which may be increased to 10% of average annual turnover (Article L. 241-5 of the French Consumer Code). The consumer also benefits from the legal guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code, for two years from the discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept, or to a full refund on returning the goods. |
11. Copyright
Buying an artwork transfers ownership of the physical object to you. It does not transfer the copyright: ownership of the intellectual work is independent of ownership of the object (Article L111-3 of the French Intellectual Property Code).
Clémence Devienne therefore keeps the reproduction and representation rights. You may display the artwork at home, lend it or resell it. However, any reproduction (print, card, derivative product, publication) requires her prior written permission.
12. Personal data
The data collected when you order is processed as described in the privacy policy.
13. Complaints and mediation
For any complaint, first write to clemencedevienne.art@gmail.com or by post to the address in section 1.
If the dispute is not resolved, you can use a consumer mediator free of charge (Article L612-1 of the French Consumer Code):
- CM2C – Centre de Médiation de la Consommation des Conciliateurs de justice
- Address: 49 rue de Ponthieu, 75008 Paris, France
- Website: https://www.cm2c.net
- Online referral: https://www.cm2c.net/declarer-un-litige.php
- Email: declarer-un-litige@cm2c.net
The mediator can only be approached if you have first tried to settle the dispute directly with us by a written complaint, and within one year of that complaint (Article L612-2 of the French Consumer Code).
14. Applicable law
These terms are governed by French law. If you live in another country, you keep the protection granted to you by the mandatory rules of your country of residence.
Failing an amicable settlement, the dispute will be brought before the competent court under the ordinary rules.
